1. Scope of Services
Burke & Sons Plumbing & Heating INC (“Company,” “we,” “us”) provides residential and commercial plumbing and heating services, including installation, repair, and maintenance. All services are subject to availability and applicable state and local codes and regulations.
2. Estimates and Pricing
- Estimates are based on visible and accessible conditions at the time of inspection.
- Additional charges may apply if unforeseen conditions arise (including hidden damage, code violations, or required upgrades).
- Any significant changes in cost will be communicated for approval before proceeding when reasonably possible.
3. Permits and Code Compliance
- Permits will be obtained when required and may be billed separately unless otherwise stated.
- All work will comply with applicable Massachusetts and New Hampshire plumbing, gas, and building codes.
- Correction of pre-existing code violations is the responsibility of the property owner unless explicitly included in the scope of work.
4. Payment Terms
- Payment is due upon completion of services unless otherwise agreed in writing.
- Accepted payment methods: [cash, check, credit card, etc.].
- Late payments may incur interest, collection fees, and/or legal costs to the extent permitted by Massachusetts and New Hampshire law.
5. Scheduling and Cancellations
- At least 24 hours’ notice is required for cancellations or rescheduling.
- Missed appointments or late cancellations may result in a service fee.
6. Access to Property
Customers must provide safe, clear, and reasonable access to all work areas. The Company is not responsible for delays, damages, or additional costs caused by restricted access, unsafe conditions, or failure to prepare the work area.
7. Warranties and Guarantees
- Labor warranties, if offered, will be provided in writing and apply only to the original work performed.
- Manufacturer warranties apply to parts and equipment where applicable.
- Warranties may be void if:
- Work is altered, repaired, or modified by others
- Systems are misused, neglected, frozen, or improperly maintained
8. General Limitation of Liability
To the fullest extent permitted under Massachusetts and New Hampshire law:
- The Company is not liable for pre-existing conditions, hidden defects, or issues not reasonably detectable at the time of service.
- The Company is not responsible for indirect, incidental, or consequential damages, including loss of use, property damage, or business interruption, except where caused by gross negligence or willful misconduct.
9. Water Damage Limitation Clause
Customer acknowledges that plumbing, heating, and piping systems carry inherent risks, including leaks, pressure failures, and water damage—especially in older or previously repaired systems.
By authorizing service, the Customer agrees:
- The Company is not responsible for water damage resulting from pre-existing conditions, corrosion, faulty piping, failed shut-off valves, frozen pipes, or system weaknesses beyond our control
- The Company is not liable for damage to walls, floors, ceilings, fixtures, landscaping, or personal property where access, removal, or disruption is reasonably necessary to perform the work
- The Customer is responsible for removing or protecting valuables, finished surfaces, and sensitive materials prior to service
Customer further agrees that:
- Any liability, if established, shall be limited to the total amount paid for the specific services giving rise to the claim
- This limitation applies to the maximum extent allowed under Massachusetts and New Hampshire law and does not apply in cases of gross negligence, willful misconduct, or where otherwise prohibited by law
10. Emergency Services
Emergency or after-hours services may be subject to additional fees. Response times are not guaranteed and depend on demand, weather, and other conditions beyond our control.
11. Website Use

- Unauthorized use of this website may result in legal action.
12. Consumer Protection Compliance
Nothing in these Terms is intended to limit or waive any rights provided to consumers under:
- Massachusetts General Laws Chapter 93A
- New Hampshire Consumer Protection Act (RSA 358-A)
or any other applicable laws or regulations.
13. Changes to Terms
We reserve the right to update these Terms of Service at any time. Updates will be posted on this page with a revised effective date.
